These Terms of Service ("Terms") govern your use of the WineMenu.ai mobile application and website (collectively, the "Service") operated by WineMenu LLC ("we," "us," or "our"). By using the Service, you agree to these Terms.
The service
WineMenu.ai uses artificial intelligence and third-party wine pricing data to analyze restaurant wine lists and provide price comparisons and recommendations. The Service is intended for personal, non-commercial use.
Eligibility
You must be at least 21 years old (or the legal drinking age in your jurisdiction, whichever is higher) to use the Service. By creating an account, you represent that you meet this requirement.
Subscriptions and billing
WineMenu.ai offers a free first scan and a paid subscription for continued use. Current pricing is displayed in the app before purchase.
- Subscriptions are billed monthly or annually as selected at purchase.
- Payment is processed by Apple or Google through their respective app stores. Their billing terms apply.
- Subscriptions renew automatically unless cancelled at least 24 hours before the renewal date.
- To cancel, use the subscription management settings in the App Store or Google Play.
- We do not offer refunds for partial billing periods, except as required by law or app store policy.
Accuracy and limitations
WineMenu.ai uses AI to read wine lists and third-party data for pricing. Results are informational only and may be inaccurate. Factors that can affect accuracy include:
- OCR and AI errors in reading wine list text or images
- Wines not in our pricing database
- Pricing data that is outdated, regionally variable, or otherwise not reflective of current market conditions
- Ambiguous or abbreviated wine list entries
WineMenu.ai does not provide financial advice. Nothing in the Service should be construed as a recommendation to purchase or avoid any specific wine or investment. Always verify pricing and availability before making a purchase decision.
Data attribution
Wine pricing data is provided by Wine-Searcher. WineMenu.ai is not affiliated with Wine-Searcher. Pricing reflects retail and auction market data and does not represent restaurant prices.
Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any regulations
- Attempt to reverse-engineer, scrape, or extract data from the Service in bulk
- Use automated tools to access the Service beyond normal app usage
- Share your account credentials with others
- Interfere with or disrupt the integrity or performance of the Service
Intellectual property
The WineMenu.ai name, logo, app design, and all original content are the property of WineMenu LLC and are protected by applicable intellectual property laws. You may not reproduce or distribute any part of the Service without our written permission.
Wine pricing data is licensed from Wine-Searcher and subject to their terms. You may not export or redistribute pricing data obtained through the Service.
Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected.
Limitation of liability
To the maximum extent permitted by law, WineMenu LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits or data, arising from your use of the Service, even if advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
Termination
We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion, with or without notice. You may delete your account at any time from the app's settings. Upon termination, your right to use the Service ceases immediately.
Changes to these terms
We may update these Terms from time to time. We'll notify you of material changes via email or in-app notice at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction in those courts.
